City Deadly Serious About FAA Fight

Re: “Enough, Says City Council, in Suing FAA” 

Mayor Jim Clarke says City Hall’s brewing lawsuit against the Federal Aviation Administration because of hundreds of complaints of overflight noise “is very significant.”

The city hopes to force the FAA to quell the noise by regulation. “We plan to take this case all the way,” Mr. Clarke said.

At the direction of the City Council, City Atty. Carol Schwab this week was told to prepare a lawsuit. “We believe there are errors in the FAA’s environmental assessment,” the mayor said.

“We believe they used an incorrect model for ascertaining noise.  They used a standard commonly used on the East Coast, but we have a different model that is required to be used for calculating noise in California.”

Had the FAA employed the proper model, said the mayor, “we believe it would have produced a finding that there was a significant impact from noise” on Culver City residents. “In turn, the FAA would have been required to mitigate against that noise.”
