Who Will Make the Next Move in the Vinton Avenue Dispute?

Re “Vinton Avenue Math: Addition or Subtraction? Both Cause a Division. Woes Multiply.

Attn. parties on both sides of the dispute as to whether the addition to 4213 Vinton Ave. should survive or disappear:

Based on a memo (see attached) issued last week by Sol Blumenfeld, Community Development Director, that appeared to stamp the disputed project with city approval, where do we go from here?

The principal complainants, neighbors Lyndon Stambler and his wife Terry A. Silberman, say that the second-story addition, begun in early March, robs their family of privacy on a property where they have lived since the early1990s. They want the addition dismantled.

In his formal memos to the City Council, Mr. Blumenfeld expressed the same approving observations he later gave to the newspaper, indicating the builder adhered to city rules.

In one key sentence in two separate memos — one textual, one containing illustrations — Mr. Blumenfeld seemed to close out the argument when he said:

“Mr. Stambler believes the project is intrusive and overbuilt, but by most standards in the City, the home and the new addition are not unusual.”

Perhaps a lawyer could espy wiggle room in the closing phrase, “are not unusual.”

Mr. Stambler is showing no signs of sounding retreat.

He told the newspaper: “This official memo to the city states that ‘the property owners on each side of the Subject Property (4209 and 4219 Vinton) have no issue with the construction of the project.’

“I actually spoke to those homeowners. They said they never had been contacted by the city.”
