Suicide Watch: Veterans to Seek Justice for Disabled Homeless Veterans

Fellow Veterans and Friends of Veterans:

More than 500,000 U.S. military Veterans had a post-traumatic stress disorder (PTSD) diagnosis in fiscal year 2012 while the suicide rate for Veterans continues to soar:

Twenty-two self-sacrificing deaths every day, one every 65 minutes, on average. (See links below.)

This tragedy has accelerated to an emergency of Biblical proportion. No safety net is in sight while the powers further neglect this desperate cry for help.
 
In an act of defiance and ingratitude, the U.S. Supreme Court recently refused to hear a lawsuit against the U.S. Dept. of Veterans Affairs (VA) for neglect in its delay of processing combat-related mental health claims that contributed to thousands of veteran suicides each year. The lawsuit was filed U.S. federal court in July 2007, asking the courts to intervene and the Supreme Court rejected it (Veterans for Common Sense v. Shinseki).

Moreover, the Obama administration is vigorously fighting an ACLU lawsuit against the VA, and U.S. federal Judge S. James Otero recently dismissed one of the claims in the suit for discriminating against disabled homeless Veterans who need supportive care and housing (Valenti v. Shinseki).

Judge Otero dismissed another claim rejecting the Deed of 1888 as an enforceable Charitable Trust for permanent housing by incredulously declaring “the government had not assumed an enforceable fiduciary duty to create housing for veterans when it accepted ownership of the land, despite explicit provisions for housing in the deed.”

Waxman Strikes Out

The legal Deed was preceded by an Act of Congress in 1887 and U.S. Rep. Henry Waxman (D-Westside/South Bay) assumed the fiduciary duty of enforcing the Act and Deed when he was elected to Congress 38 years ago. He has failed miserably, disgracefully, violating his own oath of office. U.S. Sen. Dianne Feinstein (D-Ca) is equally culpable.

This travesty is not only a perversion of the legal law but the universal law of morality, doing unto others.

Our government’s continuing abuse and neglect further punish disabled, disadvantaged, homeless Veterans who defended our nation's homeland while it rewards wealthy special-interest groups with complete takeover of Veterans’ land at their National Home. 

If our U.S. government did not assume an enforceable fiduciary duty to create housing for these veterans, how did a wealthy homeowner group assume the “stewardship” of Veterans’ entire property for public tourism while 20,000 disabled Veterans have been evicted, forced to live homeless and hungry?

Is It Worthwhile?

Why would any parent want his sons or daughters to serve our nation today? The best they could hope for is that they fulfilled their Military Oath of pledging their lives for our country and were killed in action with honor, instead of coming back disabled, distraught and commit suicide on American soil because of an ungrateful government.

It's time for justice. The only justice Veterans can expect is a moral victory by holding a “Veteran Tribunal” and publicly trying Commander-in-Chief Barack Obama, Congressman Waxman, Sen. Feinstein, the nine justices of the U.S. Supreme Court, and U.S. federal Judge S. James Otero for Human Rights Violation, Crimes Against Humanity, Violation of the Americans With Disability Act, Willful Neglect, Humiliating and Degrading Treatment,  Reckless Disregard, Endangerment and Discrimination, along with other major charges!
